Terms of Service

These Terms of Service ("Terms") govern your use of Kylo AI ("Service"), operated by Kylo AI ("we", "us", "our") at kyloai.online. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use Kylo AI.

1. Eligibility

You must be at least 13 years old to use Kylo AI. By using the Service, you represent that you meet this requirement. Users under 18 must have parental consent. We reserve the right to terminate accounts of users who misrepresent their age.

2. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring your use of Kylo AI complies with applicable laws in your jurisdiction
• Providing accurate information during registration and payment

You must notify us immediately at admin@kyloai.online if you suspect unauthorized access to your account.

3. Acceptable Use

Kylo AI is designed for legitimate creative, entertainment, and professional streaming purposes. You agree to use the Service only for lawful purposes.

• Non-consensual deepfakes: Using Kylo AI to create or distribute realistic representations of real people without their explicit consent, particularly for the purpose of deception, harassment, defamation, or non-consensual intimate imagery.
• Identity fraud: Using the Service to impersonate another person for fraudulent purposes, including financial fraud, scams, or identity theft.
• Harassment and abuse: Using AI-generated content to harass, threaten, intimidate, or harm any individual or group.
• Illegal content: Creating, distributing, or using the Service in connection with any content that is illegal under applicable law, including but not limited to child sexual abuse material (CSAM), terrorist content, or incitement to violence.
• Misinformation: Deliberately creating and distributing AI-generated content designed to deceive the public, manipulate elections, or spread harmful false information.
• Circumventing security: Attempting to reverse engineer, exploit, or bypass any security measures, rate limits, or access controls on the Service.
• Unauthorized automation: Using bots, scripts, or automated tools to access the Service in ways not permitted by these Terms.
• Reselling without permission: Reselling, sublicensing, or commercially redistributing access to the Service without our express written consent.
• Platform manipulation: Using Kylo AI to violate the terms of service of third-party platforms (e.g., streaming platforms, social networks) where you broadcast content.

4. Content and Intellectual Property

You retain ownership of content you create using Kylo AI. However, you represent and warrant that:

• You have the right to use any faces, voices, or likenesses processed through the Service
• Your use does not infringe the intellectual property rights of any third party
• Content you create complies with the platform rules of any service where you publish it

Kylo AI and its underlying technology, trademarks, and service marks are owned by us. You may not use our branding without written permission.

5. Payments and Refunds

All purchases on Kylo AI are for prepaid streaming time. By completing a payment, you agree to the following:

• Payments are processed in Nigerian Naira (NGN) through Korapay or Paystack
• All sales are final. Refunds are issued only at our discretion in cases of verified technical failures on our end
• Session time begins when you start streaming, not when you pay
• We reserve the right to change pricing with notice to registered users
• Fraudulent chargebacks will result in permanent account termination

6. Service Availability

We aim to provide reliable service but do not guarantee 100% uptime. We may:

• Perform scheduled maintenance (we will notify users in advance where possible)
• Experience unplanned outages due to third-party service failures
• Modify or discontinue features with reasonable notice

We are not liable for losses resulting from service interruptions outside our reasonable control.

7. AI-Generated Content Disclaimer

Kylo AI uses third-party AI models for real-time video transformation. You acknowledge that:

• AI output quality may vary and is not guaranteed
• AI transformation results depend on your camera quality, lighting, and internet connection
• We do not endorse or take responsibility for how you use AI-generated content
• You are solely responsible for compliance with any laws applicable to content you create and distribute

8. Termination

We reserve the right to suspend or permanently terminate your account at any time, with or without notice, if you:

• Violate any provision of these Terms
• Engage in fraudulent, abusive, or illegal activity
• Create risk or legal exposure for Kylo AI or its users
• Attempt to circumvent payment, security measures, or access controls

Upon termination, your access to the Service will be revoked. Any unused prepaid balance may be forfeited if termination is due to a violation of these Terms.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Kylo AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including but not limited to loss of data, loss of revenue, or reputational harm.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to us in the 30 days preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kylo AI and its operators from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or use of the Service shall be resolved under Nigerian jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 7 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
